Intellectual Property Right Infringement Policy

MERCATRADE respects intellectual property right law and expects its Users to do the same. MERCATRADE has instituted the following procedure to report copyright and other intellectual property infringements by users posting content and information on our website.

Notice of intellectual property right infringement

If you believe that your work has been copied in a way that constitutes an intellectual property right infringement and if you are duly authorized to act on behalf of the company or the individual owning the rights on this work, please provide MERCATRADE legal department with the written information specified below. Please note that this procedure is exclusively for notifying MERCATRADE of any infringement.

1- a description of the work that you claim has been infringed upon;

2- your full legal name and an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other  intellectual property rights interest

3- a description of where the material that you claim is infringing is located on the website, including the listing number, if applicable

4- your address, telephone number and e-mail address

5- a statement by you that you have a good-faith belief that the disputed use is not authorized by the owner of the intellectual property rights, its agent or the law

6- a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the owner of the intellectual property rights or that you are authorized to act on behalf of the owner of the intellectual property rights.

Receipt notification and material removal

Upon reception of a proper notice of intellectual property right infringement, we notify the user of the receipt of a notice of intellectual property infringement, we promptly remove or disable access to the allegedly infringing material (listing, content or information) and we provide the user with your contact information. By doing so, MERCATRADE is not endorsing a claim of infringement.

Repeat infringements

MERCATRADE, in appropriate circumstances and at its sole discretion, will terminate registered users or other account holders whom it determines to be repeat infringers. MERCATRADE may also at its sole discretion limit access to the website and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement and this without prior notice.  

Important

While MERCATRADE considers all such notices seriously, you may be liable for damages (including costs and attorney's fees) if you materially misrepresent that material or activity is infringing. Accordingly, if you are uncertain whether material infringes your intellectual property right, you may seek the advice of an attorney.
